關于唐山勞務派遣的法律常識有哪些

一、用工比例問題

1、用工單位應當嚴格控制勞務派遣用工數量,使用的被(bei)派遣(qian)勞動者數量不得超過其用工總量的10%。

2、用工總量是(shi)指用工單位訂立勞動(dong)合同人數與(yu)使用的被派(pai)遣勞動(dong)者人數之和。

3、計算唐山勞務派遣用工比例的(de)用(yong)(yong)工單位(wei)是指依照勞(lao)動合(he)(he)同法(fa)和勞(lao)動合(he)(he)同法(fa)實施條例可以與勞(lao)動者(zhe)訂(ding)立勞(lao)動合(he)(he)同的(de)用(yong)(yong)人單位(wei)。

4、用工單位在使用被派遣勞動者時,應當注意用工比例問題,以免因勞務派遣用工超比例而出現違法用工情形;同時要注意,如果勞務派遣用工超比例,則應當按照《規定》要求在2016年3月1日之前降至規定比例;如果是在2012年12月28日之前依法訂立的勞動合同和勞務派遣協議期限屆滿日期在2016年3月1日以后的,可以依法繼續履行至期限屆滿;為了保護用工單位的合法權益,如果用工單位有勞務派遣用工超比例現象,應當及時制定調整用工方案,并報當地人力資源社會保障(zhang)行政部(bu)門(men)備案,以免日后出現不必要的爭議(yi)的糾紛。

二(er)、唐山勞(lao)動合(he)同、唐山勞(lao)務派遣協議及(ji)三方當(dang)事人的法律關系(xi)

1、勞(lao)動(dong)合同:勞(lao)務派(pai)遣單位應當依法(fa)與被派(pai)遣勞(lao)動(dong)者訂立2年以上的固定(ding)期(qi)限(xian)書面(mian)勞(lao)動(dong)合同;勞(lao)務派(pai)遣單位與該被派(pai)遣勞(lao)動(dong)者可以約定(ding)試(shi)用期(qi),但只能(neng)約定(ding)一次使(shi)用期(qi)。

2、勞(lao)務(wu)派(pai)遣(qian)協議:勞(lao)務(wu)派(pai)遣(qian)單(dan)(dan)位依法與用(yong)工單(dan)(dan)位簽訂的勞(lao)務(wu)派(pai)遣(qian)協議。

三、勞動合同的解除和終止

勞(lao)(lao)動(dong)合同(tong)的解除和(he)終止,是勞(lao)(lao)務派(pai)遣(qian)單位與被(bei)派(pai)遣(qian)勞(lao)(lao)動(dong)者之間的法律關系;但用工單位可以(yi)依法退回被(bei)派(pai)遣(qian)勞(lao)(lao)動(dong)者,此時勞(lao)(lao)務派(pai)遣(qian)單位應(ying)當依法妥善(shan)處理(li)勞(lao)(lao)動(dong)關系。

四(si)、跨地(di)區勞(lao)務派遣的社(she)會(hui)保險

因(yin)為我國行政(zheng)地域廣大,各(ge)地區(qu)的社(she)(she)保(bao)政(zheng)策并不完全(quan)一致,因(yin)此(ci)在(zai)跨地區(qu)勞務派(pai)遣(qian)的社(she)(she)會保(bao)險問題(ti)上,應(ying)(ying)當注意(yi)各(ge)地的具體政(zheng)策;總原則是(shi):社(she)(she)會保(bao)險應(ying)(ying)當在(zai)用(yong)(yong)工(gong)(gong)單位所(suo)在(zai)地辦理參保(bao)手續(xu),繳(jiao)納社(she)(she)會保(bao)險費(fei);勞務派(pai)遣(qian)單位在(zai)用(yong)(yong)工(gong)(gong)所(suo)在(zai)地沒有分支機構的,由(you)用(yong)(yong)工(gong)(gong)單位代為辦理參保(bao)手續(xu),繳(jiao)納社(she)(she)會保(bao)險費(fei)。

五、法律責任
